These Terms of Use ("Terms") govern your access to and use of the https://trackcast.tv website and all related apps and services (the "Service"), operated by TRACK ("TRACKCAST," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
1. Acceptance & Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal authority to agree to these Terms.
2. Ownership, Intellectual Property & Broadcast Rights
All content available through the Service—including but not limited to live and archived video streams, audio, broadcasts, timing and scoring data, telemetry, graphics, text, images, logos, trademarks, and metadata (collectively, the "Content")—is the exclusive property of TRACKCAST or its licensors and is protected by U.S. and international copyright, trademark, and broadcast law.
TRACKCAST retains exclusive worldwide broadcast, streaming, reproduction, and distribution rights to the Content. No ownership rights are transferred to you.
3. Limited License (Personal Use Only)
TRACKCAST grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Service solely for personal, private, non-commercial use, subject to these Terms.
4. Prohibited Activity (Zero-Tolerance)
Unless expressly authorized in writing by TRACKCAST, you may not:
Broadcast, restream, retransmit, or distribute the Service or Content. Record, screen capture, mirror, embed, or reproduce Content. Create clips, highlights, or derivative works. Use the Service for commercial purposes or public exhibition. Display the Service in bars, venues, racetracks, watch parties, or paid events. Circumvent DRM, security features, device limits, or access controls. Share login credentials or allow third-party access.
Any violation constitutes a material breach and may result in termination without refund and legal action.
5. One Stream Per User (Concurrent Use Policy)
Each purchase permits one (1) concurrent stream per account. You may not stream on more than one device simultaneously or share or resell your account. TRACKCAST reserves the right to monitor usage and terminate streams or accounts that exceed authorized use.
6. Monitoring & Enforcement
TRACKCAST may monitor account activity, device identifiers, IP addresses, and session data to enforce these Terms and prevent misuse. We may suspend or terminate access immediately for suspected or confirmed violations.
7. Commercial Viewing & Venue Use
All purchases are valid for private, personal viewing only. Commercial or public exhibition requires a separate written licensing agreement with TRACKCAST. Unauthorized venue use is strictly prohibited.
8. Purchases, Billing & Authorization
Pay-per-view (PPV) and replay purchases are charged at the time of purchase as one-time transactions. By completing a purchase, you authorize TRACKCAST to charge your payment method for the amount displayed at checkout. Replay access is subject to the time-limited access window specified at the time of purchase.
9. No Refunds
All purchases are final and non-refundable, except as required by law. No refunds will be issued for failure to watch, partial use or unused time, or enforcement/termination due to Terms violations.
10. Chargebacks & Disputes
You agree not to initiate a chargeback or payment dispute for authorized charges resulting from your purchase. TRACKCAST may submit this Agreement, usage records, account data, and access logs as evidence. Improper chargebacks may result in account termination and future purchase bans.
11. Injunctive Relief & Damages
Unauthorized broadcasting, restreaming, or commercial use causes irreparable harm. You agree that TRACKCAST is entitled to immediate injunctive relief without bond, as well as all available damages, costs, and attorneys' fees.
12. Termination
TRACKCAST may suspend or terminate access immediately for any violation of these Terms. Provisions relating to ownership, IP protection, enforcement, billing, and liability survive termination.
13. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law principles.
14. Changes to Terms
TRACKCAST reserves the right to update these Terms at any time. Material changes will be posted on the Service. Continued use constitutes acceptance.
